‘You could be a model’: Judge tells Qld kidnapper

A CAIRNS judge has told a young woman she could be a model as she was sentenced for her involvement in a violent kidnapping.

Kody Schieber, 23, made it known she wanted no involvement in the kidnapping of Maitland Chitty early last year.

But she reluctantly complied with a request from her boyfriend Melchor Garcia to drive the bounded and gagged Mr Chitty from a location in Woree to a location in Little Spence St about 6am on February 28.

Garcia, who pleaded guilty to a raft of charges on Friday including torture and kidnapping, had a drug debt with the victim.

The pair had planned to exchanged methylamphetamines for hand guns, but Mr Chitty didn't come up with the weapons after receiving the drugs.

Crown prosecutor Nicole Friedewald told the Cairns District Court that Garcia kidnapped and took Mr Chitty to a remote location in the Kuranda bush and tortured him for a prolonged time frame.

Schieber became involved afterwards when she was called by a co accused to pick them up.

"She said that she didn't want to be a part of it," Ms Friedewald said.

But she did.

While in the car, Mr Chitty managed to loosen the ropes around his hands and began strangling Garcia.

At this point Schieber got out of the car and pulled Mr Chitty from the vehicle.

The 23-year-old pleaded guilty this morning to deprivation of liberty.

Ms Friedewald said the crown accepted that her involvement was minimal, but the overall offending was serious.

Defence barrister Timothy Ryan said his client was ashamed of her behaviour describing her as a reluctant participant and her actions as an "error in judgment".

At a vulnerable time in her life, she began a relationship with Garcia and began taking drugs.

Since this offending, she has left Cairns and lives with her father in Brisbane. She works full time for a cleaning company and planned to study physiotherapy.

"She is a person who has excellent prospects of rehabilitation," Mr Ryan said, adding that Schieber had a remarkably narrow band of culpability.

Judge Dean Morzone QC accepted that Schieber was "remorseful and deeply ashamed".

He described the nature of the violence against Mr Chitty as extreme but Schieber's involvement as minor.

Judge Morzone placed Schieber on s 15-month probation order "to give you the best chance to get your life back on track".

Judge Morzone said she was an attractive and intelligent woman.

"You could do anything from walking on a catwalk at an international level to being a scientist," he said.

No conviction was recorded.

Three other co accused are still facing court for their alleged involvement in the matter.
